1. Service Overview

NexCore Labs ("Company," "we," "us," or "our") provides professional digital solutions services to student-led projects at Sultan Qaboos University. These Terms of Service ("Terms") govern your use of our services and the creation of your project page.

By engaging our services, signing up on our platform, or accepting a service agreement, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

2. Eligibility & Compliance

Who Can Use Our Services

• Student-led projects at Sultan Qaboos University
• SQU-affiliated student organizations and clubs
• University research initiatives and academic projects

Verification

We may require verification of your SQU affiliation. Providing false information about your eligibility may result in immediate termination of services without refund.

Prohibited Use

You agree not to use our services for:

• Illegal activities or content
• Hate speech, harassment, or discrimination
• Adult or explicit content
• Intellectual property infringement
• Misinformation or disinformation
• Commercial activities unrelated to your academic project
• Malware distribution or system attacks

3. Service Description

What We Provide

NexCore Labs provides the following services based on your selected plan:

• Page design and development
• Analytics integration and setup
• Technical support and maintenance
• Deployment and post-launch support

What's Not Included

• Content creation
• Ongoing content updates beyond the included support period
• Premium design customization (beyond scope)
• Third-party integrations (may incur additional costs)

Service Timeline

Typical project timeline is 2-10 days from initial consultation to launch. Delays may occur due to client feedback delays or scope changes. We'll communicate any timeline adjustments promptly.

Pricing & Plans

All services are currently free during our growth phase. Pricing details will be available in the future as we develop our service offerings.

Setup Fee

• One-time setup fee: 0.500 OMR (covers initial consultation, design, and deployment)
• Waived for Professional subscription

Student Discount

SQU students receive 20% discount on all plans. Discount is applied automatically upon verification of SQU email address.

Cancellation & Refunds

• All Plans(Starter&Professional): Can be cancelled with 30 days notice. Plans include a 7-day refund guarantee.
• Setup Fees: Non-refundable once work has commenced
• In cases of service failure, refunds will be prorated based on service availability

5. Intellectual Property Rights

Your Content

You retain full ownership of all content you provide to us (text, images, logos, videos, etc.). You grant us a license to use this content solely for the purpose of creating your page.

Third-Party Assets

Your page may include third-party assets (icons, fonts, libraries) that are licensed for use. You agree to comply with their respective licenses.

Code Access

Upon project completion, we provide you with access to your project's source code via GitHub. You may modify, maintain, and deploy the code yourself.

6. Content & User Responsibility

Content Guidelines

You are responsible for:

• Ensuring all content is accurate and not misleading
• Obtaining necessary permissions for any third-party content
• Complying with all applicable laws and university policies
• Not including copyrighted material without proper attribution
• Ensuring content doesn't violate anyone's rights

Content Review

We reserve the right to review all content and request changes if content violates these Terms or is inappropriate. We are not responsible for content moderation beyond initial launch.

User-Generated Content

If your page allows users to submit content (comments, forms, etc.), you are responsible for monitoring and moderating that content according to applicable laws.

7. Security & Compliance

• DDoS protection via Cloudflare
• Web Application Firewall (WAF)
• Regular security audits and updates
• Automated daily backups

Your Responsibilities

• Keep login credentials confidential

• Maintain security best practices for any custom modifications

All pages are built to comply with GDPR, WCAG 2.1 accessibility standards, and industry security best practices. For projects handling payment information, we ensure PCI DSS compliance.

8. Limitation of Liability

Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Damages

Except where prohibited by law, our total liability for any claims arising from these Terms or our services shall not exceed the total amount you paid us in the 12 months preceding the claim.

Excluded Damages

In no event shall we be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of revenue, profits, or data
• Business interruption
• Third-party claims or actions

Uptime Guarantee

We guarantee 99.9% uptime for your page under normal circumstances. If your page experiences greater downtime, we offer service credits as your sole remedy (up to one month of service).

9. Termination

Termination by You

• All Plans(Starter&Professional):: Can terminate with 30 days written notice
• You'll receive access to your data and source code upon termination

Termination by NexCore Labs

We may terminate your service immediately if you:

• Violate any provision of these Terms
• Engage in illegal activities
• Use the service to harm others or violate their rights
• Fail to pay invoices after 30 days notice
• Breach security protocols or engage in unauthorized access attempts

Upon Termination

• Your page will be taken offline within 30 days
• Your source code will be provided for archival purposes
• Data will be deleted after 90 days unless otherwise agreed

10. Changes to Service

Service Modifications

We may modify or discontinue services with 30 days notice. If changes materially affect your service, we'll provide a refund or alternative options.

Terms Updates

We may update these Terms at any time. Continued use of our services constitutes acceptance of updated Terms. Major changes will be communicated at least 30 days in advance.

Price Changes

We may adjust pricing for new subscriptions. Existing plans will not be affected until renewal, with 30 days notice required before changes apply.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Oman, without regard to its conflict of law provisions. Any legal action or proceeding will be brought exclusively in the competent courts of Oman.

By using our services, you consent to the jurisdiction of Oman courts and waive any objection to venue.
